# TERMS OF SERVICE
## Overview
This website is operated by Color City Automotive Paint & Supply. Throughout this website, the terms "we," "us," and "our" refer to Color City Automotive Paint & Supply.
By accessing our website or purchasing our products, you agree to be bound by these Terms of Service. If you do not agree with these Terms, please do not use this website.

PRODUCTS

We make every effort to accurately display our products and colors. However, due to monitor settings, lighting conditions, factory color variants, vehicle age, fading, oxidation, previous repairs, application techniques, environmental conditions, and normal manufacturing tolerances, actual colors may vary.
Automotive paint is a specialized product. An exact color match cannot be guaranteed based solely on a paint code, VIN, color name, or vehicle information.

CUSTOMER RESPONSIBILITY

Customers are solely responsible for providing accurate vehicle information, including but not limited to:
• Year
• Make
• Model
• Paint Code
• VIN (when applicable)
• Product selection
• Paint system
• Finish
• Quantity ordered
Color City Automotive Paint & Supply prepares paint solely based on the information provided by the customer.
We are not responsible for vehicles that have been previously repainted, custom painted, restored, modified, wrapped, refinished, repaired, or altered using a color different from the original factory color.
A vehicle's VIN or factory paint code may not match the vehicle's current color due to previous repainting, collision repairs, restoration work, custom paint jobs, fading, oxidation, weathering, or modifications performed by another party.
It is the customer's responsibility to verify that the requested paint code or custom color matches the actual vehicle before placing an order.
Color City Automotive Paint & Supply is not responsible for errors resulting from incorrect, incomplete, outdated, or inaccurate information provided by the customer.

ORDERS

We reserve the right to refuse, limit, modify, or cancel any order at our sole discretion.
Orders may be canceled due to:
• Pricing errors.
• Product availability.
• Suspected fraud.
• Incorrect customer information.
• Shipping restrictions.
• Compliance with applicable laws or regulations.

PRICING

All prices are listed in U.S. Dollars (USD).
Prices, product specifications, availability, and promotions are subject to change without prior notice.

CUSTOM MIXED PAINT AND CUSTOM-FILLED AEROSOLS
------------------------------------------------------------
Custom mixed automotive paint, custom color-matched paint, and custom-filled aerosol spray paint are manufactured specifically for each customer's order.
Once the paint mixing process has begun or an aerosol has been filled, the order cannot be modified, canceled, returned, exchanged, adjusted, or refunded.
These products are FINAL SALE.
Custom-filled aerosol spray paint cannot be adjusted because the paint cannot be recovered once it has been filled into the aerosol can.
No exceptions will be made for custom-filled aerosol products.

FACTORY COLOR VARIANTS
------------------------------------------------------------
Many vehicle manufacturers produce multiple factory color variants under the same paint code.
Unless otherwise agreed, Color City Automotive Paint & Supply will prepare the standard manufacturer variant available in our color system.
Factory color variants are a normal characteristic of the automotive refinishing industry and are not considered product defects.
Differences caused by factory color variants are not grounds for returns, refunds, exchanges, adjustments, or claims.

COLOR VERIFICATION BEFORE APPLICATION

Customers are strongly advised to perform a spray-out test and verify the color match before applying paint to any vehicle or part.
Automotive paint appearance and performance may vary depending on numerous factors beyond our control, including but not limited to:
• Surface preparation.
• Sanding procedures.
• Primer color and type.
• Sealer color.
• Product compatibility.
• Mixing ratios.
• Reducers, activators, and hardeners used.
• Spray equipment.
• Spray gun setup.
• Air pressure.
• Spray technique.
• Number of coats applied.
• Flash times.
• Drying and curing conditions.
• Temperature.
• Humidity.
• Environmental contaminants.
• Existing vehicle finish.
• Previous repairs or repainting.
Color City Automotive Paint & Supply cannot guarantee the final appearance or performance of paint after application because these factors are beyond our control.
Customers are solely responsible for verifying the color before applying paint to an entire vehicle or part.
Once paint has been applied, it is considered accepted by the customer.
Customers are responsible for confirming color accuracy, finish, and product suitability before proceeding with full application. Failure to perform a spray-out test does not constitute a product defect or qualify the purchase for a refund, exchange, replacement, or store credit.
No refunds, exchanges, adjustments, reimbursement for labor, or reimbursement for materials will be provided once the paint has been applied.

PROPER PRODUCT USE AND APPLICATION

All products sold by Color City Automotive Paint & Supply are intended to be used by trained professionals or individuals familiar with proper automotive refinishing procedures.
Customers are responsible for following the manufacturer's Technical Data Sheets (TDS), Safety Data Sheets (SDS), product instructions, recommended mixing ratios, application procedures, flash times, curing times, and all safety recommendations.
The final appearance and performance of automotive paint depend on numerous factors beyond our control, including but not limited to:
• Proper surface preparation.
• Proper sanding procedures.
• Primer selection and compatibility.
• Primer color.
• Sealer color.
• Product compatibility.
• Mixing ratios.
• Activators, reducers, and hardeners used.
• Spray equipment.
• Spray gun setup.
• Air pressure.
• Spray technique.
• Number of coats applied.
• Flash times.
• Drying and curing conditions.
• Temperature.
• Humidity.
• Environmental contaminants.
• Existing vehicle finish.
• Previous repairs or repainting.
Color City Automotive Paint & Supply is not responsible for paint failures, adhesion problems, color differences, gloss variations, texture issues, orange peel, peeling, delamination, solvent popping, lifting, wrinkling, fisheyes, contamination, or any other application-related issues resulting from improper preparation, improper application, incompatible products, environmental conditions, failure to perform a spray-out test, or failure to follow manufacturer recommendations.
Customers are solely responsible for verifying product compatibility before use.

LIMITATION OF LIABILITY

Customers are responsible for reviewing and verifying all order information before completing their purchase.
Color City Automotive Paint & Supply shall not be liable for labor charges, repainting costs, additional materials, rental vehicle expenses, towing charges, loss of use, business interruption, lost profits, or any indirect, incidental, consequential, special, exemplary, or punitive damages resulting from the purchase, use, misuse, installation, storage, transportation, application, or performance of any product sold.
Under no circumstances shall the total liability of Color City Automotive Paint & Supply exceed the purchase price paid for the product giving rise to the claim.

SHIPPING

Shipping times displayed during checkout are estimates only.
Color City Automotive Paint & Supply is not responsible for delays caused by shipping carriers, weather conditions, hazardous material transportation requirements, incorrect shipping information provided by the customer, carrier delays, or circumstances beyond our reasonable control.
Risk of loss and ownership transfers to the customer once the order has been accepted by the shipping carrier.

INTELLECTUAL PROPERTY

These Terms of Service shall be governed by and interpreted in accordance with the laws of the State of Michigan and the applicable laws of the United States.
Any dispute arising from the use of this website or the purchase of products shall be resolved exclusively in the appropriate state or federal courts located in the State of Michigan.
